The petitioners are apprehending their arrest in connection with Sonepur P.S.Case No.1183 of 2018 , registered for offences punishable under Sections 30(a), 37(C ) and 38 of the Bihar Excise and Prohibition Act, 2016.

The allegation is about recovery of 17 and odd ltrs. of liquor near the Sudha Parlour of the petitioner. Submission of the learned counsel for the petitioners is that nothing has been recovered from inside the Sudha Parlour of the petitioner and also they have no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named,

Patna High Court Cr.Misc. No.7364 of 2019(2) dt.07-02-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned 6th Additional District and Sessions Judge, Saran at Chapra in connection with Sonepur P.S.case No.1183 of 2018 dated 5.12.2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
