The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code As per the prosecution case, the petitioner and others are stated to have assaulted the informant leading to various injuries.

It is submitted by learned counsel for the petitioner that the allegations against the petitioner are false and concocted. He has been falsely implicated in the case. The injuries have been found to be simple in nature. The so called grievous injury is not on the vital part of the body. The petitioner is in custody since 23.11.2020 and charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the nature of allegation together with the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Dumariaghat P.S. Case no. 138 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran.
