2. The petitioner is in custody in a case registered for the offence punishable under Sections 191(3), 190, 126(2), 115(2), 308(2), 329(4), 74, 352 and 351(2) of the Bhartiya Nyay Sanhita, 2023.

3. Allegation against the petitioner and other coaccused persons is to have assaulted the informant by means of butt of the pistol and also to get extortion money of Rs.1,00000/-

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case on the basis of suspicion. He next submits that as a matter of fact, no such

Patna High Court CR. MISC. No.5943 of 2025(3) dt.19-04-2025 2/2 occurrence as alleged in the FIR ever took place and the informant has unnecessarily dragged the petitioner in the present case owing to village politics as stated in para-7 of the petition. Petitioner is in custody since 18.11.2024.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

On perusal of the first information report, case diary and impugned order dated 04.10.2025, it appears that the informant has compromised the case and the informant and the petitioner are co-villagers and similarly situated co-accused persons have already been granted anticipatory bail by a Coordinate Bench of this Court passed in Cr. Misc. No.1964 of 2025, so considering all aspects of the matter, I am inclined to grant bail to the petitioner.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Bhojpur at Ara in connection with Karnamepur P.S. Case No. 34 of 2024.
