JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Petitioner seeks bail in connection with Excise Case No. C2-677 of 2019, registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act. Allegation is of recovery of 504 litres of Nepali Saufi liquor and petitioner along with another co-accused was arrested there and others succeeded in fleeing away.

Submission of learned counsel for the petitioner is that altogether 13 accused persons were carrying the liquor and seeing police they succeeded in fleeing away except petitioner and another accused, who have been arrested and petitioner is in custody since 3.11.2019 and charge sheet has been submitted, as such there is no chance of tampering with the evidence and petitioner has no criminal antecedent.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi, in connection with Excise Case No. C2-677 of 2019.
