====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 11-08-2022 Heard Mr. Arvind Kumar, learned counsel for the petitioner.

Petitioner is the plaintiff in the suit. The grievance of the petitioner is that the Defendant No. 1 was debarred from filing written statement, but on a petition filed by defendant No. 8 to produce defendant No. 1 as Defendant Witness No. 6 on behalf of the Defendant No. 8, has been allowed. Learned counsel for the petitioner submits that Defendant No. 1 was debarred from filing written statement and order of debarment has been upheld up to the High Court. As such, she cannot be examined as witness on behalf of other Defendants.

Patna High Court C.Misc. No.212 of 2018(3) dt.11-08-2022 3/3 I have heard learned counsel for the petitioner and have gone through the impugned order. The Trial Court has come to the conclusion that Defendant No. 1 was debarred from filing written statement and the Defendant No. 8 in his list of witnesses has mentioned the name of Defendant No. 1 as Defendant Witness No. 6, as such, preventing the Defendant No. 8 from examination of witnesses from the list of Defendant Witness will amount to miscarriage of justice. In view of the aforesaid conclusion of the learned Trial Court, I am of the view that there is no illegality in the impugned order.

Accordingly, this application stands dismissed. (Anil Kumar Sinha, J) S.Ali/- U
