Petitioner seeks bail in a case registered for the offences punishable under Sections 8(c)/21(b)/29 of N.D.P.S.Act.

Perused the report of the learned District Judge, Patna. It appears that similarly situated some other coaccused were allowed bail by the same Presiding Judge after framing of the charges on 27.01.2021 and considering the custody of those accused. Prayer for bail of the petitioner was refused on 11.01.2021.

The learned court below should have directed in the matter of the petitioner also that after framing of the charges, the petitioner may renew prayer for bail to avoid unnecessary harassment to the petitioner in approaching this Court.

No.17746 of 2021(3) dt.07-10-2021 2/2 Considering the fact that similarly situated co-accused have been allowed bail by the learned court below, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No.143 of 2020 arising out of Hawai Adda Police Station Case No.156 of 2020 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
