The petitioner seeks bail in Khizer Sarai P.S.Case No.135 of 2015 registered for the offences punishable under Section 364(A) of the Indian Penal Code.

The victim was recovered from the Patna Railway Station but the victim in her statement under Section 164 of the Cr.P.C. disclosed that nobody had kidnapped her. She went along with her brother to the house of her maternal uncle. The victim denied the factum of kidnapping. The petitioner is in custody since 04.06.2015. He has already remained in jail for more than two months.

Considering the facts aforesaid and the nature of the allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.38599 of 2015 (2) dt.28-08-2015 Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Miss Akanksha Kashyap, Judicial Magistrate, Ist Class, Gaya in connection with Khizer Sarai P.S.Case No.135 of 2015.
