Learned counsel for the petitioner undertakes to remove the defects within three weeks of normal functioning of the court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 302 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that similarly situated co-accused have been granted bail by coordinate Benches of this Court in Cr. Misc. No. 12430 of 2020 on 29.02.2020 and in Cr. Misc. No. 30042 of
Patna High Court CR. MISC. No.17513 of 2021(2) dt.12-03-2021 2/2 2020 on 12.02.2021. He submits that there is general and omnibus allegation upon the petitioner. He further submits that petitioner is in custody since 22.05.2020.
In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Nawada in connection with Kawakole P.S. Case No. 226 of 2018.
