The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act.

From a two wheeler standing in the name of brother of the petitioner, liquor was recovered and co-accused-Chhotu Singh was apprehended.

Submission is that the father of the petitioner had given the said motorcycle to Chhotu Singh to bring medicines for his ailing mother. Petitioner has got no criminal antecedent. Considering lack of direct material against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on
