The petitioner is languishing in custody since 7.12.2018 in a case registered for the offences punishable under Sections 30(a) and 41(i) of the Bihar Prohibition and Excise Act, 2016. Prosecution case is that from the possession of the petitioner, 81 litres of illicit Nepali liquor were recovered. It is submitted by learned counsel for the petitioner that the petitioner is not having any criminal antecedent. Learned APP submits that the recovery has been made from the petitioner.

Considering the period under custody, the investigation being concluded, coupled with statement made in paragraph 3 of the petition that the petitioner is not having any
