2. The petitioner apprehends his arrest in a case registered for offence under Sections 354B / 506 / 509 of the Indian Penal Code, Sections 14 / 15 of the POCSO Act and Sections 66(C), 66(D) of the I.T. Act.
3. As per prosecution case, petitioner alongwith two other co-accused, named in the F.I.R., are alleged to have posted obscene photograph of the victim (daughter of the informant).
4. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case merely on suspicion. Petitioner is a student and he is only alleged to have threatened the informant's son and obscene photo of victim was got viral through unknown fake I.D. During course of investigation, police has not found any cogent material against this petitioner to show his complicity in the present occurrence. It is further submitted that the alleged mobile number, by which the
Patna High Court CR. MISC. No.9754 of 2024(4) dt.06-05-2024 2/2 photograph of the victim got viral, does not belong to this petitioner and as such, no offence, as alleged in the F.I.R., is made out against him. Petitioner has got clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Court-cum-Addl. District and Sessions Judge - VI, Gaya in connection with Civil Line P.S. Case No. 423 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
