The petitioner seeks bail in Roh P.S. Case no. 14/2015, registered for the offences punishable under Section 392 of the Indian Penal Code.
Four accused persons committed robbery of the bag of the informant. The petitioner was not arrested on the spot. It is submitted that the petitioner was arrested far away from the place of occurrence and arms and ammunitions were recovered for which Govindpur P.S. Case no. 11/2015 was registered under the aforesaid Section of the Arms Act. The police recorded confessional statement of the petitioner. Save and except the confession, no tangible material is collected and the petitioner is not put on Test Identification Parade, although he is in custody
Patna High Court Cr.Misc. No.39462 of 2015 (2) dt.07-09-2015 2/2 since 17.03.2015. Similarly situated co-accused Mahesh Rajbanshi and Rakesh Kumar have already been enlarged on bail. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Roh P.S.
