JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2019 This is an application for grant of anticipatory bail in connection with G.O. Case No. 162 of 2018 (Town P.S. Case No. 35 of 2018), disclosing offences under Sections 401, 272, 272, 201, 414 of the Indian Penal Code and Sections 30(A), 46, 41 of the Bihar Prohibition and Excise Act.

Allegation as per F.I.R. is that police on information of unloading of liquor from a Bolero vehicle, raided a place and arrested some accused persons. Petitioner is not named in the F.I.R., later on his name transpired during course of investigation.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and nothing has been recovered from his possession. Further, he has no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV-cum-Special Judge, Darbhanga, in connection with G.O. Case No. 162 of 2018 (Town P.S. Case No. 35 of 2018), subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/- U T
