JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-12-2021 Let the defects, as pointed out by the office, be removed when called upon to do so by the office. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered in connection with Dehri(T) P.S Case No. 3 of 2020 for the offences punishable under Sections 147, 148, 149, 341, 342, 337, 307, 353, 504,120B of the Indian Penal Code.

As per prosecution case, when Police party raided to

Patna High Court CR. MISC. No.17506 of 2021(2) dt.13-12-2021 2/2 village Rudrapura Mahdeva and Gopi Bigha where Binod Singh and his associates were making stone by crusher machine. Police demolished crusher machine but at the same time anti social elements along with one hundred fifty people assembled and started to raise slogans and pelted stones on the police party. Firing was also made by the accused persons. Learned counsel for the petitioner submits that there is general and omnibus allegation against the petitioners. No overt act against the petitioners. Some other accused were granted bail by a co-ordinate Bench of this Court in Cr. Misc No. 33737 of 2020 vide order dated 26.02.2021.

In the facts and circumstance of the case, let the petitioners , above named, in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri in connection with Dehri(T)_ P.S Case No. 3 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.
