JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being husband of the deceased is languishing in jail custody since 24.04.2014 in a case registered for the offence punishable under Section 304 B of the Indian Penal Code.

In course of investigation, the further statement of informant was recorded at para-3 of the case diary and in the aforesaid further statement the informant stated that ten days prior to death of the deceased he had gone to meet the deceased and came to know that on 04.12.2013, his daughter was put on fire by the petitioner and his other family members and thereafter,

Patna High Court Cr.Misc. No.38339 of 2014 (3) dt.06-02-2015 petitioner and his other family members got treated the deceased in their village through untrained person and when her condition started deteriorating, the deceased was taken to P.M.C.H where she died on 26.12.2013.

Taking note of further statement of the informant as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Patna in connection with Dhanarua P.S. Case No. 28 of 2014.
