JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehend his arrest in a case registered for the offence punishable under Section 30(a)of the Bihar Prohibition and Excise Act, 2016.

There is recovery of 22 litres of foreign wine was recovered from the house of the petitioner Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the house nor the conscious possession of petitioner.

Learned counsel for the State submits that the petitioner has got seven criminal antecedents out of which one is of similar nature.

Considering the fact that the petitioner has got seven
