Petitioner apprehends his arrest in connection with Kotwali (Jogsar T.O.P.) Bhagalpur P.S.Case No. 845 of 2017 registered for the offences punishable under Sections 409, 420, 467, 468, 471 and 120B of the Indian Penal Code. Allegation against the petitioner is of obtaining job on the forged certificate which after enquiry was also found to be fake. Submission of learned counsel for the petitioner is that he is still in job to the satisfaction of the authority concerned and the allegation is false and concocted. Further submission is that two other co-accused having similar allegation have been granted the privilege of anticipatory bail vide order dated 27.2.2018 passed in Cr.Misc.No. 6326 of 2018 and vide order dated 6.3.2018 passed in

Patna High Court Cr.Misc. No.23686 of 2018 (2) dt.20-04-2018 2/2 Cr.Misc.No. 4849 of 2018 by co-ordinate Bench of this Court. Heard learned APP also.

Having heard both sides and in view of the fact that similarly situated co-accused have been granted the privilege of anticipatory bail, let the petitioner, above named, surrender in the court below within a period of four weeks from the receipt of this order and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Jogsar T.O.P.) Bhagalpur P.S.Case No. 845 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and petitioner will co-operate in investigation, otherwise his bail bond shall be cancelled.
