The petitioner apprehends his arrest in Basopatti P.S. Case No.25 of 2015 registered under Sections 366(A), 363 and 34 of the Indian Penal Code.

The father of the victim alleged that in the night of 20/21.02.2015 the petitioner kidnapped his minor daughter aged about 15 years.

Learned counsel for the petitioner submits that the victim appeared and made her statement under Section 164 of the Cr.P.C.. She disclosed that she voluntarily left her house and solemnized marriage with the petitioner. The victim disclosed her age to be 20 years and the court also assessed the age of the victim to be 20 years.

Having considered the facts that the victim herself

Patna High Court Cr.Misc. No.6841 of 2019(2) dt.06-02-2019 2/2 denied the factum of her kidnapping, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Madhubani in connection with Basopatti P.S. Case No.25 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
