Patna High Court CR. MISC. No.10928 of 2020(2) dt.04-03-2020 2/3 CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-03-2020 Heard the learned counsel for the petitioners and the learned APP for the State.
The petitioners apprehend their arrest in connection with Alauli P.S. Case No. 251 of 2019, G.R No. 2152 of 2019 for the offence punishable under Sections 147, 447, 354, 427, 385, 387, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
The allegation is regarding the accused persons including the petitioners herein having arrived at the field of the informant and had tried to forcibly plough the field as also the accused persons had demanded extortion money. It is further alleged that the accused persons had entered into an altercation with the informant and his family members.
The learned counsel for the petitioners has submitted that the petitioners are innocent, a general and omnibus allegation has been levelled against them, and they are having clean antecedent. It is further submitted that on account of previous land dispute, the petitioners have been falsely implicated in the present case and, moreover, the F.I.R has been lodged after a delay of four days of the alleged date and time of occurance.

No.10928 of 2020(2) dt.04-03-2020 3/3 Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioners, as also taking into account the fact that there is no injury report on record of the case and a general and omnibus allegation has been levelled against the petitioners, hence, I deem it fit and proper to direct for release of the petitioners on anticipatory bail.
Accordingly, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioners above named are directed to be released on anticipatory bail on furnishing bail-bonds of Rs. 10,000/-(rupees ten thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 251 of 2019, G.R No. 2152 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
