The petitioner seeks bail in a case registered for the offences punishable under Sections 420, 467, 468, 471 and 120(B)/34 of the Indian Penal Code.

The informant alleged that the petitioner mortgaged his land and took loan from the bank.

It is submitted that the name of grand father of the petitioner is Budhan Mahto and the name of grand father of the informant is also Budhan Mahto. Due to bona fide mistake, the land of the informant was given to the bank at the time of grant of loan. When the petitioner knew about the mistake, he filed the mortgaged deed to rectify that mistake. No loss was caused to the informant. The petitioner is in jail since 24.5.2015.

No.40176 of 2015 (2) dt.01-09-2015 2/2 Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, (West) Muzaffarpur in connection with Kathaiya P. S. Case No. 59 of 2014.
