The petitioner being the husband of the complainant is languishing in custody since 19.05.2014 in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.
The basic accusation is of torture.
The petitioner was released for a month on provisional bail for reconciling the issue but the report of the Mediator suggests that the issue has not been reconciled. It is submitted by learned counsel for the complainant that a frivolous case has been lodged against the
Patna High Court Cr.Misc. No.25662 of 2014 (08) dt.09-01-2015 2/2 complainant by the mother of the petitioner and the marriage has not been disputed, but the petitioner is not maintaining the complainant.
Considering the nature of accusation and the period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Complaint Case No. C-I/91 of 2012.
