Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Excise P.S. Case No. 654 of 2022 dated 23.12.2022 registered for the offences punishable under Section 30(a) and 30(c) of Bihar Prohibition and Excise Act, 2016.

The main submissions advanced by learned counsel for petitioner are that the instant matter mainly relates to the recovery of 150 litres of illicit country made wine but the said wine was recovered from barren (parti) land which does not belong to this petitioner, infact the petitioner's house is situated nearby the said land and he was falsely implicated in this case merely on the basis of suspicion and the petitioner is very young person of nineteen years and he has fair and clean antecedent

Patna High Court CR. MISC. No.7646 of 2023(2) dt.01-05-2023 2/2 and has been languishing in jail since 24.12.2022. 4.

Learned APP for the State has opposed the bail prayer of the petitioner.

Considering the above submissions and mainly the petitioner's young age, his clean antecedent and the completion of investigation against him, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Excise P.S. Case No. 654 of 2022.
