JUSTICE ANJANI KUMAR SHARAN ORAL ORDER (Per: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR) 25-02-2022 Heard Mr. Binay Kumar, learned Advocate for the petitioner and Mr. Vishambhar Prasad for the State. The petitioner is aggrieved by the order dated 24th of January, 2022, passed by the Sub-divisional Officer, Sadar Gaya/Licensing Authority whereby the licence of the petitioner has been cancelled. It is the contention of the petitioner that the order primarily is based on the report of the Block Development Officer, Tankuppa and Block Project Manager, B.R.L.P.S., Tankuppa.
We find that the explanation of the petitioner
Patna High Court CWJC No.2025 of 2022(2) dt.25-02-2022 2/2 and the charges against him have been examined by the Sub-divisional Officer, Gaya. We do not find any reason to interfere with this order. However, we do intend to allow the petitioner to have the liberty of challenging the aforesaid order before the appellate authority. Should such an appeal be filed by the petitioner before the competent appellate authority within a period of thirty days, it shall be taken up for consideration and after giving reasonable opportunity to the petitioner to explain his cause, a final order shall be passed within a further period of sixty days, which order shall be communicated to the petitioner forthwith.
With the aforesaid direction and liberty to the petitioner, the petition stands disposed of.
