The petitioner seeks bail in a case registered for the offences punishable under sections 302 and other allied sections of the Indian Penal Code.

The informant named eight persons and alleged that they came to his shop and assaulted Sugriv Sah. In the meantime, Amit Kumar, brother of the informant came and on the order of Hari Shankar Choudhary, Krishna @ Megha Yadav assaulted Amit Kumar with axe on his head. It is alleged that other accused persons also assaulted Amit Kumar but from the order of the learned Sessions Judge, it appears that Amit Kumar died due to the injury found on his head. Petitioner is not the assailant of Amit Kumar.

Patna High Court Cr.Misc. No.40284 of 2015 (2) dt.01-09-2015 Considering the facts aforesaid, the petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Pachrukhi (Sarai O.P.) P.S. Case No. 99 of 2015.
