JUSTICE JYOTI SARAN ORAL ORDER 15-07-2016 Heard Mr. Rakesh Kumar Singh for the petitioner and Mr. A.P. Sahay, learned counsel appearing for the Bihar State Food and Civil Supplies Corporation.

Mr. Sahay, learned counsel for the Corporation while filing the counter affidavit submits that the grievance of the petitioner to question the advertisement dated 23.5.2016 is only insofar as it relates to the District of Siwan and the reason is that the agreement entered in between the petitioner and the Corporation was yet existing and is to expire only in 2018. He submits with reference to the statement made in paragraph-4 to the counter affidavit filed today that it is in consideration of the grievance raised that the Corporation has decided to cancel the

Patna High Court CWJC No.9203 of 2016 (4) dt.15-07-2016 tender advertised, insofar as the District of Siwan is concerned and thus the petitioner should have no grievance. In view of the stand taken in the counter affidavit, nothing survives in the writ petition which is disposed of. The interim order passed on 09.6.2013 accordingly stands vacated.
