JUSTICE SUDHIR SINGH ORAL ORDER 30-11-2015 Heard the counsel for the petitioner, complainant and counsel for the State.

The petitioner is languishing in jail since 08.07.2015 in a case instituted under Sections 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

As per prosecution case, it is a case of demand of dowry and torture against the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.07.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner is said to be the husband

Patna High Court Cr.Misc. No.43449 of 2015 (3) dt.30-11-2015 of the complainant and he has already remained in custody about five months. Petitioner is ready to cooperate during the pendency of the trial.

On behalf of the State and the counsel for the complainant, it has been submitted that the petitioner is the husband of the complainant and also named in the complaint case. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Gaya in connection with Complaint Case No.1650 of 2008, Trial No.612 of 2014.
