The petitioner is in custody in connection with Tekari P.S. Case No. 03 of 2020 for the offenses under Section 30(c) of the Bihar Prohibition & Excise Act, 2016 and Sections 3, 5, 18 of Bihar Mahua Phool Act, 2006.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 100 kgs of Mahua flower was recovered from the motorcycle but not from the conscious possession of the petitioner. The petitioner is in custody since 05.01.2020.
Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on
Patna High Court CR. MISC. No.6818 of 2020(2) dt.04-02-2020 2/2 furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Gaya, in connection with Tekari P.S. Case No. 03 of 2020.
