2. The petitioner seeks bail in connection with Saharsa Sadar P.S. Case No. 658 of 2023 registered for the offence under Section 25(1-B)a, 26 and 35 of the Arms Act.

3. As per the prosecution case, one country made pistol has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case.

5. It is also submitted by the learned counsel for the petitioner that the petitioner has clean antecedent and he is in jail since 20.09.2023.

6. Learned APP for the State vehemently opposed

Patna High Court CR. MISC. No.9605 of 2024(2) dt.20-02-2024 2/2 the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saharsa in connection with Saharsa Sadar P.S. Case No. 658 of 2023.
