JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-04-2023 The present writ petition has been filed seeking the following relief:- "1. That this is an application for issuance of a Writ in the nature of mandamus commanding and directing the respondents authorities to remove the encroachment made by the private respondents in connivance with the anti-social elements of the village- Bandiha, Rosera, over the public land pertaining to Khata No. 86 (old) 324 (new) and Khesra No. 11320 and

Patna High Court CWJC No.12807 of 2016(2) dt.04-04-2023 2/2 12078 (New) total area measuring about one acre and ninety two dismal which was being used by the people of the locality for public purposes as also by the students as play ground, but the private respondents are not only encroached the public land by making illegal hutment but also trying to grab the land. And/or issue any other appropriate direction to the District Collector, Samastipur to redress the grievance of the petitioner as under the land dispute redressal act District Collector is the competent authority to resolve the land dispute.

And/or issue any other writ / writs, order/orders, direction/directions which may be found just and proper in the facts and circumstances stated hereunder."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner / affected persons to approach the Respondent authorities for redressal of their grievances, if any.
