JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2018 The petitioner is apprehending his arrest in connection with Chowk P.S. Case No. 334 of 2017, registered for offences punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is of firing on the informant causing injury to him.
It has been submitted on behalf of the petitioner that there is delay in lodging the F.I.R. and whole prosecution is false and concocted one and petitioner is the victim of local politics and he is a student.
Heard learned A.P.P. also.
Having heard both sides, considering the fact that there is allegation against the petitioner of firing on the informant causing
Patna High Court Cr.Misc. No.14207 of 2018 (2) dt.11-04-2018 2/2 injury on his leg, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather the petitioner if so desire may surrender before the court below and pray for regular bail, and the court below shall consider the same on the basis of merit of the case and shall pass an appropriate order, without being prejudiced by the order of this Court.
