JUSTICE PRABHAT KUMAR JHA ORAL ORDER 28-08-2015 Heard learned counsel for the petitioners, learned counsel for the informant as well as learned APP. The petitioners seek bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The informant named ten persons and alleged that Hiraman Sah and Hiralal Sah caught his son Praveen Kumar and Bangali Sah assaulted him with iron rod causing death of his son. It is submitted that there is no allegation of assault against the petitioners. Similarly situated co-accused Jagdeo Sah has already been enlarged on bail.

Learned counsel for the informant as well as the learned

Patna High Court Cr.Misc. No.38263 of 2015 (2) dt.28-08-2015 2/2 APP has opposed the prayer for bail of the petitioners. Considering the facts aforesaid, the petitioners above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in Bettiah Mufassil (Manuapul) P.S. Case No. 163 of 2015.
