JUSTICE PRABHAT KUMAR JHA ORAL ORDER 26-08-2015 Heard Sri Dev Narayan Yadav, the learned counsel for the petitioner, and the learned Additional Public Prosecutor. The petitioner seeks bail in a case under Section 304B and other sections of the Indian Penal Code. The informant alleged that his daughter was married to petitioner on 20.06.2013 but within six months of her marriage she was killed in her Sasural. The petitioner was demanding dowry. The post mortem report shows that the victim died due to asphyxia on account of strangulation.
It is submitted that seven witnesses have already been examined but they did not support the case of prosecution. Considering the nature of allegation and the fact that petitioner is the husband and his wife died within six months of
Patna High Court Cr.Misc. No.38435 of 2015 (2) dt.26-08-2015 2/2 marriage, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
The trial court is directed to expedite the trial and hold the same on day to day basis and conclude the trial within three months from the date of receipt of this order. (Prabhat Kumar Jha, J) BKS/- U T
