Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 376, 201/34 of the Indian Penal Code.

The F.I.R. was lodged, after cremation of the dead body of the wife of the informant, with allegation that the petitioner and others named in the F.I.R. are suspected to have raped her and committed her murder. The suspicion is for the reason that quarrel took place few days ago for trivial dispute. Submission is that there is no eyewitness of the occurrence, nor there is any other corroboration of the allegation. The petitioner has got no criminal antecedent. He is in custody since 10.09.2018. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Saraiya Police Station Case No.404 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
