The petitioner seeks bail in a case registered for the offence under Sections 307, 326, 34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the F.I.R., this petitioner is alleged to be ordergiver and handed over the pistol to the co-accused Keshaw Kumar, who made two consecutive firing upon the informant and caused fire-arm injury on his thumb.

It is submitted on behalf of petitioner that as per F.I.R. itself, petitioner is only alleged to be order-giver and handed over pistol to co-accused Keshaw Kumar, who fired and injured the informant. Petitioner is in custody since 20.09.2021. Learned counsel for the State and informant opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Begusarai in connection with Nowkothi P.S. Case No. 71 of 2021.
