2. Learned counsel for the petitioner submits that earlier the regular bail petition of the petitioner was rejected vide order dated 28.03.2023 passed in Cr. Misc. No. 67727 of 2022. The regular bail petition of the petitioner was rejected by this Court and while rejecting the regular bail petition, it was observed that if the trial is not concluded within a period of nine months, the petitioner may renew his prayer for bail.

3. Learned counsel for the petitioner has submitted that even after elapse of 11 months, the trial has not been concluded till date.

4. Considering the above-mentioned facts and

No.9574 of 2024(2) dt.16-02-2024 2/2 circumstances, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge-1st, Special Judge, N.D.P.S. Act, Begusarai in connection with Sahebpur Kamal P.S. Case No. 251 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
