====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-03-2025 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 115(2), 126(2), 351(2), 352, 109, 117(2), 303(2) of the Bharatiya Nyaya Sanhita.
3. As per written report of the informant, allegation is that all the F.I.R. named accused persons including these petitioners, variously armed with lathi, danda, fattha, pistols, entered the house informant and thereafter, assaulted informant and her family members. It is further alleged that they also took away gold chain, mobile phone and cash of Rs. 5,000/-.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.7756 of 2025(2) dt.03-03-2025 2/2 petitioners have falsely been implicated in this case. He further submits that to land dispute between the parties, simple altercation took place. Allegation of assault is general and omnibus and there is no specific allegation of overt act against these petitioners. Case and counter case. Rest of the allegations are ornamental to make the case grave. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Madhepura P. S. Case No. 864 of 2024, subject to condition as laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, 2023.
