The petitioner seeks bail in connection with Sessions Trial No. 238 of 2019 arising out of K. Hat P.S. Case No. 299/2016 instituted for the offences under Sections 304(B) /34 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected twice vide orders dated 11.01.2018 and 18.01.2021 passed in Cr. Misc. Nos. 56273 of 2017 and 8076 of 2020 respectively.
This Court had called for a report about the stage of the case from the court below. The report discloses
Patna High Court CR. MISC. No.6408 of 2022(3) dt.23-03-2022 2/2 that all the prosecution witnesses have been examined and the case is pending for examination of defence witnesses. However, looking at the nature of accusation against the petitioner, who is the husband of the deceased, I am not inclined to grant bail to him notwithstanding the fact that he is in custody since 11.07.2016.
The prayer for bail, therefore, is rejected.
Considering the stage of the case, this Court directs that the trial be concluded within a period of four months from the date of receipt / production of a copy of this order.
