2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 365, 366 of the Indian Penal Code.
3. As per prosecution case, on 2.12.23 at about 11:30 AM, two daughter of the informant went to the college to appear in examination but thereafter, they did not return. Later on, informant came to know that the daughter of informant was talking with one unknown mobile holder bearing No. 911703386, who disclosed that he kidnapped both her daughters.
4. Learned counsel for the petitioner submits that petitioner is an innocent lady and has falsely been implicated in this case. He further submits that there is contradictory
Patna High Court CR. MISC. No.6042 of 2025(2) dt.27-02-2025 2/2 statement of the victim recorded under Section 161 Cr.P.C. and Section 164 Cr.P.C. which itself raises doubt over veracity of the prosecution case. Petitioner claims clean antecedent.
5. However, learned A.P.P. for the State vehemently opposed the bail application and submitted that during investigation, both the girls have been recovered and it is found that one of the girls is minor and in her statement recorded under Section 164 Cr.P.C., she has specifically alleged that this petitioner got her kidnapped for the purpose of marriage with her son and kept her in captivity for a week.
6. Considering the nature of accusation and statement of the victim recorded under Section 164 Cr.P.C., prayer for anticipatory bail of the petitioner is refused. (Prabhat Kumar Singh, J) Navya/- U T
