The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.
The informant named six persons, namely, Umesh Singh, Ram Pravesh Singh, Arbind Singh, Anil Singh, the petitioner, Kush Singh and Sunil Singh and alleged that when his cousin Rambali Yadav, Dewan Yadav, Ramdutta Yadav went to protest, as the accused persons were putting pole in his lands, all the accused persons are said to have assaulted Rambali Yadav, Dewan Yadav and Ramdutta Yadav and Rambali Yadav succumbed to the injuries.
It is submitted that omnibus and general allegation of assault is made against all the six accused persons including the petitioner. Arbind Singh, Sunil Singh and Kush Singh have
Patna High Court Cr.Misc. No.40098 of 2015 (2) dt.01-09-2015 2/2 already been enlarged on bail vide order passed in Cr. Misc. No. 47307 of 2014 and the case of petitioner stands on the same footing. Only one injury was found on the head of the deceased and the occurrence took place on account of land dispute. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Pauthu P.S. Case No. 43/2014.
