Heard the learned counsel for the petitioner and learned APP for the State.
This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 30(a) of the Bihar Prohibition and Excise Act, registered in connection with CIS No. 1573 of 2021 arising out of Atri P.S.Case No. 296 of 2021.
As per allegation, 20 litres of counry-made wine was recovered from the petitioner's motor-cycle. The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.6903 of 2022(2) dt.26-05-2022 2/2 that the petitioner is in custody since 30.08.2021. His bail petition was rejected by the learned court below on the ground that the petitioner has one criminal antecedents of similar nature.
Considering the period of detention, the petitioner above-named is directed to be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II, cum-Special Judge, Excise, Gaya in connection with CIS No.1573 of 2021 arising out of Atrri P.S.Case No. 296 of 2021.
The learned trial court is directed to take every endeavour to frame the charge as early as possible. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
