The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.

The prosecution case in nutshell is that six miscreants came on two motorcycles, with their faces covered with Helmets and towels(Ghamcha). It is further alleged that they started firing at the doorstep of the shop and thereafter, they entered into the shop of informant and after making hostage to informant's daughter and two staffs,

Patna High Court CR. MISC. No.6830 of 2023(2) dt.12-04-2023 2/3 they looted away 500 grams Gold ornaments and 13 kg Silver ornaments, worth Rs. 27 lakhs. While retreating they also cut the wire of CCTV camera.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Neither the petitioner is named in F.I.R nor he has been put on T.I.P. Nothing incriminating has been recovered from his conscious possession. The name of petitioner sprang up in this case on the basis of confessional statement of one Sushant Mishra, before the police, which has no evidentiary value in the eye of law. Moreover, the petitioner is languishing in judicial custody since 02.07.2022.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Baheri P.S.
