2. The petitioner seeks regular bail in connection with Kaluahi P.S. Case No. 168 of 2023 registered for the offence under Sections 302, 201/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, an unidentified dead body was recovered which was killed and thrown by the miscreants with an intention to wipe out the evidence.
4. Learned counsel for the petitioner submits that except for the confessional statement of the co-accused, there is no material against the petitioner. Petitioner is in custody since 02.08.2024. One co-accused namely Badri Narayan Yadav @
Patna High Court CR. MISC. No.6983 of 2025(2) dt.21-02-2025 2/2 Badri Yadav has been granted regular bail vide order dated 06.02.2024 passed in Cr. Misc. No. 439 of 2024.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail after framing of charge, if the charges have not already been framed on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani/concerned Court below in connection with Kaluahi P.S. Case No. 168 of 2023 subject to condition that:- 7(i). The petitioner will mark his attendance at the Nanpur Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
