Ms.Madhuri Lata, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 13-02-2026 Heard learned counsel for the petitioners and learned APP for the State.
2. The accused-petitioners, named in the F.I.R., are apprehending their arrest in connection with Hulashganj P.S. Case No. 254 of 2024 registered for the offences punishable under Sections 80(2), 238(a) & 3(5) of the Bhartiya Nyay Sanhita, 2023 (in short, the 'B.N.S.').
3. As per FIR, petitioners alongwith other co-accused persons/family members caused death of daughter of the informant due to non-fulfillment of demand of dowry as raised for a cash of Rs. 50,000/- which was demanded by the husband of the deceased namely, Sunny Kumar.
4. Learned counsel appearing on behalf of the petitioners
Patna High Court CR. MISC. No.8888 of 2026(2) dt.13-02-2026 2/3 submitted that both petitioners are brother-in-law and sister-in-law of the deceased and they implicated only being relative of main coaccused, namely Sunny Kumar. 6. Learned A.P.P. for the State opposed the prayer of bail.
7. In view of the aforesaid factual submissions and by taking note of the fact as the demand of dowry is specific against the husband of the deceased daughter of the informant, namely Sunny Kumar, where implication of these petitioners, prima-facie appears being relative as mentioned aforesaid, accordingly, both above-named petitioners, who are of clean antecedents, in the event of their arrest/surrender within a period of four weeks from
