2. The petitioner is in custody since 22.08.2023 in connection with Nirmali P.S. Case No. 167/2023 registered for the offence punishable under Section 394 of the Indian Penal Code.
3. As per the prosecution case, the allegation against the petitioner and other criminals is of looting a motorcycle and a mobile phone.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that nothing incriminating has been recovered from the possession of the petitioner. He next submits that the petitioner has not been put on T.I.P. The petitioner has no criminal

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Birpur, Supaul in connection with Nirmali P.S. Case No. 167/2023.
7. The petitioner is directed to mark his attendance in Nirmali Police Station, Supaul on 1st Sunday of every month failure to do so, will result in cancellation of bail bond of the petitioner.
