BAJANTHRI ORAL JUDGMENT Date : 11-03-2022 This matter is heard via video conferencing due to circumstances prevailing on account of the COVID-19 Pandemic. In the instant petition, petitioner has prayed for the following reliefs:- "(i) To issue writ/order or direction in the nature of Certiorari for setting aside the order contained in memo no. 1201 dated 06.08.2020 issued under the signature of District Magistrate-cumCollector, Gopalganj by which pursuant to the departmental proceeding the petitioner has been dismissed from his service with immediate effect.
(ii) To issue writ/order or direction in the nature of mandamus com-
Patna High Court CWJC No.2258 of 2022 dt.11-03-2022 2/2 manding the respondents to restore the service of the petitioner with all consequential benefits. (iii) To hold and declare that the entire departmental proceeding as initiated against the petitioner including the order of imposition of penalty is not tenable in the eyes of law and liable to quash and accordingly direct the authorities to grant consequential benefits as a result thereof.
(iv) To any other relief or reliefs for which the petitioner is found to entitled in the facts and circumstances of the case."
Feeling aggrieved by the disciplinary authority order petitioner is stated to have preferred an appeal before the appellate authority and it is pending consideration.
Therefore, the appellate authority is hereby directed to decide petitioner's appeal within a period of four months from the date of receipt of the order, in accordance with law and probity. With the aforesaid observations, the present writ petition stands disposed off.
