JUSTICE SUDHIR SINGH ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 24.05.2015 in connection with Chowk P.S. Case No. 95 of 2015 for the offences instituted under Section 366(A)/34 of the IPC. The accusation is of kidnapping the minor daughter of the informant.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 24.05.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence against the petitioner. From perusal of Annexure-2 it would appear that the victim girl has admitted that she had left with the
Patna High Court Cr.Misc. No.40576 of 2015 (3) dt.14-10-2015 2/2 petitioner for the purpose of marriage and from perusal of Annexure-3 it would appear that the petitioner and the victim girl have already been married.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Patna City, Patna, in connection with Chowk P.S.
