2. In the present case, the petitioner seeks bail in connection with Parsa Bazar P.S. Case No. 372 of 2024, registered for the offences under Sections 341, 376, 504, 506 of the Indian Penal Code.
3. As per the prosecution case, petitioner who was friend of husband of the informant, threatening the informant with gun, committed rape with her and thereafter, he continued his act on different dates. When the daughters of the informant saw the petitioner committing rape with the informant, the husband of the informant came to know about the fact. The husband of the informant went to the house of the petitioner where he was threatened by the brother of the petitioner.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The FIR has been lodged after two months of the occurrence and it shows the falsity of the allegation. It is clear from the FIR that the petitioner is friend of the husband of the informant. He extended a loan to him and in order to grab the loan amount, this false case has been lodged. The petitioner is having antecedent of one case and he is in custody since 28.09.2024. Charge sheet has been submitted.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner. Learned A.P.P. submits that there is specific allegation against the petitioner for committing rape with the informant.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the delay in lodging the FIR and further considering the submission of charge sheet and period of custody of the petitioner, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned J.M.F.C., Patna/concerned court, in connection with Parsa Bazar P.S. Case No. 372 of 2024, subject to the condition
Patna High Court CR. MISC. No.7320 of 2025(2) dt.19-02-2025 3/3 laid down under Section 437(3) of the code of Criminal Procedure and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
