JUSTICE SUDHIR SINGH ORAL ORDER 13-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 394 of the Indian Penal Code.
Allegation against the petitioner is that he along with other accused persons snatched Rs, 7,600/-, A.T.M cards, mobile and motorcycle from the informant.
It has been submitted on behalf of the petitioner that he is in custody since 16.5.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner is not named in the F.I.R. He has not been put on T.I.P. It is further submitted that petitioner may be released after completion of nine months in custody from 16.5.2015. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R. but A.T.M. cards of the informant is said to have been recovered from the possession of this petitioner. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of

No.39881 of 2015 (3) dt.13-10-2015 2 / 2 nine months in custody from 16.5.2015 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Bhawanpur P.S. Case no. 45 of 2015.
