JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The name of petitioner surfaced in course of investigation. The victims were recovered from the house of coaccused, Rahul Kumar. The statement of victims was recorded under Section 161 of the Cr.P.C. and one victim, namely, Rinku Kumari disclosed that petitioner had committed rape on her but when her statement under Section 164 of the Cr.P.C. was recorded, she did not state about the story of rape nor named the petitioner in her statement. Furthermore, the statement of victims reveals that victims had left their houses by their own sweet will. Considering the aforesaid facts and circumstances as

Case No. 33 of 2014.
