JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-06-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Kotwa P.S. Case No. 190 of 2019 for the offence under Sections 414/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that the name of the petitioner surfaced on the basis of confessional statement of co-accused, Kundan Kumar, who was apprehended with the alleged looted motorcycle. He further submits that nothing was seized from the possession of the petitioner.

Considering the fact that the petitioner has got no criminal antecedent and his name surfaced on the discloser

No.5453 of 2020(3) dt.30-06-2020 2/2 made by co-accused, Kundan Kumar, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-X, East Champaran, Motihari in connection with Kotwa P.S. Case No. 190 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure with the further condition with the condition that the petitioner on release will render his service as volunteer for a period of one month in dedicated Covid Hospital. He is required to report to the District Nodal Officer in the concerned region, who shall utilize his service in this pandemic.
